Privacy Policy
OUR POLICY
The collection, storage and sharing of client information on consumers is an important part of delivering useful banking products and services. To serve you, as a consumer, efficiently and conveniently, we have to make use of modern technology and customer information. We know that you are concerned about privacy and our use of the information you give us, and we are committed to an ongoing review of our procedures and policies in the interest of protecting your privacy. As a result, we have established the following privacy policy to provide guidance in our dealings with consumers.
DEFINITIONS
Certain terms in this Notice have the following definitions:
- We, our and us means Pinnacle National Bank its joint employees and its affiliates.
- You and Your means consumer clients with whom we have a continuing relationship, such as a deposit account or loan, consumers using special services from us such as ATM transactions without any account, and consumers who applied for a loan that was declined by the bank or withdrawn by the consumer.
- Publicly available information means information lawfully available to the general public from official public records generally from courthouses and information commonly listed in telephone directories or various forms of media and information required by state, federal or local law such as securities filings.
- Non-public personal information means personal financial information about you that we collect in connection with providing you with a financial product or service that is not made publicly available as described above.
- Affiliate means any company we own or control or that owns or controls us.
- Nonaffiliated third party means any person, company or partnership that is not an affiliate or joint employee of us.
- Consumer reporting agency means an entity that collects and evaluates consumer credit information for the purpose of furnishing consumer reports to third parties.
INFORMATION WE COLLECT
We collect non-public information about you from the following sources:
- Information we receive from you on applications or other forms.
- Information about your transactions with us.
- Information about your transactions with nonaffiliated third parties.
- Information we receive from consumer reporting agencies, from your employer or prior employers.
CATEGORIES OF INFORMATION WE MAY DISCLOSE ABOUT YOU
From time to time, we may disclose non-public personal information about you to business partners that perform services on our behalf, to financial institutions or securities companies with whom we have joint contractual agreements. Our agreements with these companies prohibit the disclosure or use of client information for any purpose other than that for which we have contracted with them. We may disclose, as permitted or authorized by law, the information we collect, as described above. This would include but not be limited to, the filing of a deed of trust or vehicle title lien.
We may disclose non-public personal information about you to our affiliates in an effort to better understand your relationship with our firm and offer you a wider range of advice. This non-public information may include, but is not limited to, your name, address, tax ID, account history and balances. These affiliated companies are financial service providers such as investment advisors and insurance brokers. (Currently our list of affiliates includes Pinnacle Advisory Services, Inc., PFP Title Company, PNFP Holdings, Inc., PNFP Properties, Inc., Pinnacle Rutherford Towers, Inc., Pinnacle Rutherford Real Estate, Inc., Pinnacle Nashville Real Estate, Inc., Pinnacle Service Company, Inc., Pinnacle Community Development, Inc., and Miller Loughry Beach, Inc.,) If you do not want your information shared within our family of affiliates, you may phone us at 1-800-264-3613.
We never, under any circumstances, sell or share your non-public information with unaffiliated, third-party organizations except where required by law.
OPT-OUT INFORMATION
If you elect to opt out of information sharing, we will treat that opt out as applying to all financial products or services that you have obtained from us in the past or that you may obtain from us in the future. We will treat an opt-out direction by any joint account holder as applying to all parties on the account. You may notify us of your intent to opt out of affiliate sharing by using the following method: you may call us at 1-800-264-3613. Your opt-out request will become effective as soon as reasonably practicable after we receive it.
If we do not receive notice of your intent to opt out of information sharing with our affiliated companies within 30 days of delivery of this notice to you, we are authorized to disclose information about you to our affiliated companies in accordance with our privacy policies and practices.
CONFIDENTIALITY AND SECURITY OF NON-PUBLIC PERSONAL INFORMATION
We restrict access to non-public personal information about you to our associates who need to know the information to provide products or services to you and as required by law and regulation. We maintain physical, electronic, and procedural safeguards that comply with Federal and State standards to guard your non-public personal information. If you close your account, payoff your loan, or become an inactive client, we will continue to follow the privacy provisions reflected in this Policy Notice.
